Welcome to SORRY ABOUT MONDAYS™! This store and website are operated by Hound Dogs Club LLC d/b/a SORRY ABOUT MONDAYS™ ("we", "us", "our"). We operate this store and website, including all related information, content, features and tools (the "Services"), through which we sell our products. Our store is powered by Shopify Inc., Shopify Commerce Singapore Pte. Ltd or Shopify International Limited, depending on where we are located, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein, including our Privacy Policy, Refund Policy, Cancellation Policy and Shipping Policy (these "Terms of Service"), describe your rights and responsibilities when you use the Services and buy our products. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services. To use the Services, including browsing our online store or purchasing our products, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information. 2. OUR PRODUCTS
We have made every effort to provide an accurate representation of our products in our online store. However, colors or product appearance may differ from how they appear on your screen due to your device and its settings. If a product arrives with a problem, our Quality Guarantee (Limited Warranty) in our Refund Policy explains what we do. Product descriptions may change at any time without notice. We may discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
3. ORDERS
When you place an order, you are making an offer to purchase and authorize us and our payment processors to charge your selected payment method for the total amount of your order. We may accept or decline your order for any reason at our discretion, subject to applicable law. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted. You can cancel an order before it ships as described in our Cancellation Policy. If we do not accept, change or cancel an order, we may notify you using the email, billing address and/or phone number provided with the order. Returns and refunds are handled according to our Refund Policy. This does not limit any rights you may have under applicable law.
4. PRICES AND BILLING
Prices, discounts and promotions may change without notice, except that we notify subscribers of price changes as described in our Cancellation Policy. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Subscriptions are billed as described in our Cancellation Policy. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges. Prices in our online store may be different from prices offered in other stores operated by third parties. We may offer promotions that are governed by separate terms. If there is a conflict between the terms for a promotion and these Terms of Service, the promotion terms will govern. You agree to provide current, complete and accurate purchase, payment and account information for all purchases made in our store, and to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed. You represent and warrant that (1) you are authorized to use the payment method you provide, (2) the information you provide for such payment method is true, correct and complete, (3) charges incurred by you will be honored by the provider of your payment method, and (4) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
5. SHIPPING AND DELIVERY
We ship orders within the time stated on the product page or at checkout, or within 30 days if no time is stated. If we cannot ship on time, we email you and let you choose to wait or to cancel for a full refund. Delivery times after shipment are carrier estimates and are not guaranteed. Except as stated in our Refund Policy, we are not responsible for delays caused by shipping carriers or by events beyond our reasonable control, including natural disasters, severe weather, labor disputes, supply shortages, utility or telecommunications outages, cyber incidents, governmental actions, or other similar events. 6. INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, images, graphics, product reviews, video, and audio, are owned by us, our affiliates or licensors and are protected by U.S. and foreign trademark, copyright and other intellectual property laws. The product listings are managed and owned by us. The purchase or delivery of any product does not grant any intellectual property rights in or to the product, its design, or underlying technology. All such rights remain with us or the original rights holder. You may use our website and its content for personal, non-commercial purposes only. This does not restrict you from reselling products you buy from us, subject to the rules on brand materials below. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. All rights not expressly granted herein are reserved. SORRY ABOUT MONDAYS™ names, logos, product and service names, designs, and slogans are trademarks of Hound Dogs Club LLC or its licensors. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
Use of our brand materials by resellers and businesses: If you resell our products or want to use our product photos, logos, product descriptions or other brand materials for any purpose, you must first request permission by email at info@sorryaboutmondays.com. You may use these materials only after you receive our written approval and the approved materials from us by email, only as approved, and without changes unless we agree otherwise. We may withdraw our approval at any time. Any use without our written approval is a violation of these Terms of Service.
7. OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We have no liability arising from or relating to your use of optional third-party tools. Any use of the optional tools is at your own risk, and you should make sure you are familiar with and approve of the terms on which they are provided by the relevant third-party provider(s). New features we offer through the Services are also subject to these Terms of Service.

9. RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify's systems to deliver the Services. Section 10 explains how Shopify uses and processes information from these interactions. However, any sales and purchases you make in our store are made directly with us. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and us, including any injury, damage, or loss resulting from purchased products. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with us.

Occasionally there may be information on the Services that contains typographical errors, inaccuracies or omissions related to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct errors, inaccuracies, or omissions, to change or update information, or to cancel orders if information is inaccurate, including after an order is submitted. If we cancel an order after payment has been collected, we promptly refund you in full.

15. TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. The following sections will continue to apply after termination: Intellectual property, Feedback and reviews, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver; entire agreement, Assignment, Governing law, Privacy policy, and any other provisions that by their nature should survive termination.
16. DISCLAIMER OF WARRANTIES
The information presented on or through the Services is made available for general information purposes only. We do not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is at your own risk.
EXCEPT AS EXPRESSLY STATED BY US, THE SERVICES (OUR WEBSITE, CONTENT AND TOOLS) ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
THIS DISCLAIMER DOES NOT APPLY TO PRODUCTS YOU BUY FROM US. PRODUCTS ARE COVERED BY OUR QUALITY GUARANTEE (LIMITED WARRANTY) DESCRIBED IN OUR REFUND POLICY AND BY ANY IMPLIED WARRANTIES THAT APPLY UNDER LAW.

18. INDEMNIFICATION

You and we consent to the jurisdiction and venue of the state and federal courts located in Travis County, Texas, except where prohibited by applicable law. Nothing in this section limits any rights you may have to bring claims in your local courts or to rely on mandatory laws that apply in your place of residence.

If there is any inconsistency between the English version and a version in another language, the most current English version will prevail. Any disputes arising out of these Terms of Service will be resolved in English unless otherwise required by applicable law.
